Court declares Kaduna govt’s reduction of retired top civil servants pension benefits as draconian, unconstitutional

The National Industrial Court, sitting in Kaduna, yesterday, declared the action of the Kaduna State government in reducing the Pension of retired Secretaries to State Government, (SSGs), Heads of Service and Permanent Secretaries as draconian, in bad faith and unconstitutional.

Recall that retired Heads of Service and Permanent Secretaries, numbering 71 in the state sued el-Rufai at the National Industrial Court over the deduction of their pension.

Counsel to the plaintiffs, Barr. Sam Atung Esq, who said the deduction started in March, 2020 without any prior notice, noted that they resorted to instituting a case at the Industrial Court on the ground of pension right of the plaintiffs as enshrined under Section 210 of the 1999 Constitution (as amended) challenging the deduction of the plaintiffs’ monthly pension by the defendants.

The Industrial Court, therefore, ordered the Kaduna State government to forthwith pay them the difference in their monthly pension commencing from March, 2020. 

In a swift reaction, Counsel to the claimants, Barr. Sam Atung said, “Justice has been served”.
